Mediation as an Alternative to Litigation

Mediation in is a process in which an impartial third party attempts to resolve a dispute between individuals or businesses. Mediation can serve as an attractive alternative to litigation. As such, it can potentially save both parties the time and financial expense of preparing for and having a judge or jury resolve the dispute in court.

Mediation is designed to foster reasonable discussion and negotiation in order to obtain a workable resolution to a wide variety of disputes. The process may vary, depending upon the mediator, but it is important to remember that unless a mutual agreement can be reached, mediation cannot resolve a dispute. Mediators are not empowered to make binding decisions.
